Palmdale Car Accident Attorneys
The roads around Palmdale and Lancaster are no strangers to serious auto accidents. The Antelope Valley Freeway (State Route 14) is a tremendously busy commuter freeway, with well over 150,000 commuters every day speeding between work in Los Angeles and home in Santa Clarita, Palmdale and Lancaster. To the east of Palmdale lies the notorious Pearblossom Highway (SR 138), which is not known as Blood Alley and Death Trap Highway because it is a safe road to travel. Unfortunately, driving with care and caution cannot always protect you from being injured in an accident caused by a speeding, reckless, negligent or distracted driver. If you are injured in a car crash due to the negligence or misconduct of another driver, the Kistler Law Firm, APC can help you hold that driver accountable and collect compensation for your medical expenses, lost wages, pain and suffering and other legal damages.
California Automobile Insurance Laws
Every driver of a vehicle operated on California roadways must maintain liability insurance (or proof of financial responsibility) to compensate a person for injuries in a traffic accident that is the driver’s responsibility. The minimum amounts required by law are $15,000 for personal injury, up to a total of $30,000 if more than one person is injured, and $5,000 for property damage. In a serious accident or multi-car collision, these limits can easily be met and exceeded by the damages involved.
Despite these low minimum amounts of coverage, car insurance in California is expensive, and as many as 17% of southern California drivers do not carry even the minimum amount. If you are struck by an uninsured driver who lacks financial resources, it can be difficult to collect any significant compensation from them. One solution is to carry uninsured motorist/underinsured motorist (UM/UIM) coverage in conjunction with your own liability policy. Insurance companies are required by law to offer UM/UIM coverage, and it is recommended that you carry as much UM/UIM as you do in liability. However, many individuals opt out of UM/UIM because they do not understand how many other drivers are uninsured and how important UM/UIM can be.
Why you need an attorney
Car insurance is supposed to be there for you when you need it, but insurance companies make money not just from collecting premiums but also by paying out as little as they can when claims are filed against them. If you are not represented by a lawyer when you talk to the insurance company, the offer they make to settle your claim will not even be close to the actual value of your claim. Their offer may look like it covers the cost to repair your vehicle and reimburse you for your medical expenses, but have you considered whether you will need further medical care in the future? Have you calculated the money you have lost from being out of work while recovering for the accident, and have you considered whether your injuries may prevent you from working in the future in the same way you could before the accident? What about your pain and suffering, or the way in which the accident has affected your ability simply to enjoy life?
Do you know how to calculate all of these damages and negotiate a full settlement with the insurance company? An experienced auto accident attorney like Paul Kistler knows what your claim is worth and can negotiate a full and fair settlement with the insurance company. If an acceptable settlement cannot be reached, the Kistler Law Firm, APC is ready to take your case to your court. When the insurance companies see they are up against an experienced trial lawyer ready to take the case all the way to a jury verdict, they are much more likely to settle out of court for a fair amount. And if they don’t, your attorney is already prepared to bring your case to the jury and let them decide.
